PROVIDING AMNESTY TO UNLICENSED CONTRACTORS UNTIL 31 JANUARY 2014



WHEREAS, there are some contractors who implement construction projects without a duly issued license;

WHEREAS, some contractors operate with the mistaken belief that possession of a DTI business name and/or a SEC registration are sufficient to operate legitimately as a contractor for private domestic construction;

WHEREAS, other contractors with expired license continue to operate because the license is not required by the project owners;

WHEREAS, quite a number of developers and project owners undertake construction by administration without the required license;

WHEREAS, the only exemptions from licensing are residential buildings built by and for the exclusive use of the owner and construction activities not exceeding P10,000 for a single project with a total of P25,000 for the year.

NOW THEREFORE, for and in consideration of the foregoing premises, the Board in its effort to encourage contractors, developers, project owners, and the like to legalize their operations, hereby RESOLVES as it is hereby RESOLVED to promulgate an Amnesty Program, as follows:

1.0 Purpose

This program shall provide for a facility for unlicensed contractors, developers, project owners, and the like to legitimize their operations by applying for a contractor ™s license under this amnesty program and paying an Additional License Fee of P10,000.

Architectural and engineering professionals engaging in activities that require a contractor ™s license

3.0 Procedure for Application

Letter-Application for amnesty
3.2
Properly accomplished license application form
3.3
AMO affidavit showing at least 2 years managerial/technical experience in the construction industry
3.4
Completion by the AMO of the AMO Seminar and Course on Construction Safety and Health (COSH) and passing of the AMO examination
3.5
DTI/SEC Registration of business name
3.6
Registration with the SSS, Philhealth and Pag-ibig
3.7
Original bank certification showing a balance of at least P45,000 dated within one month from application
3.8
Upfront payment of the P10,000 ALF and other applicable fees

4.0 Category and Classification under the Amnesty Program

All applicants for the Amnesty Program will be granted Category œTrade  with the classification of Specialty œTrade 

5.0 Effectivity

The Amnesty Program shall take effect until 31 January 2014.
