EXCLUSION OF FB VAN UNITS AS PROPOSED UNITS FOR SCHOOL TRANSPORT SERVICE AND PROVIDING THE YEAR MODELS FOR PROPOSED SUBSTITUTE UNITS

On 23 April 2004, the Board issued Memorandum Circular (MC) No. 2004-012 providing guidelines School Transport Service Rationalization Program with the purpose of ensuring safety and welfare of students.

After scrutiny of the existing policies governing School Transport Service (STS) and consultation with our STS operators, the Board, with the end in view of ensuring adequate, safe, convenient and dependable STS units, hereby mandates the following:

  1. Item D of MC No. 2004-012 is hereby amended by excluding side-facing passenger vans as proposed units for STS. Hence, Item D shall now read as follows, to wit:

    œD. MOTOR VEHICLE TYPE

    The types of motor vehicles allowed for School Transport Service are as follows:

    1. Van (front-facing seats with individual seatbelts for passengers);
    2. Mini-Bus, Coaster, Coach; and,
    3. Bus. 

  2. Authorized units that are to be phased out in 2015 may be substituted by units listed in Item D of MC No. 2004-012 as revised by this Circular, which are not more than five (5) years old from the date of manufacture per DOTC- LTO-LTFRB Joint Administrative Order No. 2014-02.

  3. Authorized units that are to be phased-out beginning in 2016 and subsequent years should be substituted by units which are not more than three (3) years old from the date of manufacture per DOTC-LTO-LTFRB Joint Administrative Order No. 2014-02.

  4. Existing authorized side-facing passenger vans are still allowed to be confirmed until the end of their phased-out years provided that they be installed with individuals seatbelts for all passengers on or before the commencement of School Year 2015-2016.

  5. Likewise, side-facing vans that have already been purchased or reserved with a down payment as proposed substitutes by the operators before the effectivity of this Circular will be considered and allowed, subject to presentation of proofs thereto, such as Sales Invoice and Delivery Receipt. The said proposed units shall be installed with individual seatbelts for all the passengers on or before the commencement of School Year 2015-2016.

  6. All operators shall submit their valid and current Parent-Teachers Association or School Certification/Endorsement upon confirmation of their units.

All other issuances inconsistent herewith are deemed modified or superseded accordingly.

This Memorandum Circular shall take effect fifteen days (15) immediately following its publication in at least one newspaper of general circulation. Let three (3) copies hereof be filed with the UP Law Center pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
