[ REPUBLIC ACT NO. 5466, April 21, 1969 ]

AN ACT REQUIRING THE COMMERCIAL ATTACHE WITH THE COOPERATION OF THE AGRICULTURAL, FINANCE, CULTURAL, LABOR AND OTHER CIVIL, ATTACHES SERVING IN DIPLOMATIC MISSIONS, OR CONSULAR OFFICES ABROAD, TO RENDER QUARTERLY REPORT.



Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Any provisions of law, rules or regulations to the contrary notwithstanding, the commercial attache with the cooperation in appropriate cases of the agricultural, finance, cultural, labor and other civil attaches who are appointed to serve in diplomatic missions or consular offices abroad, is hereby required to submit not later than fifteen days after each quarter of the year reports to the President of the Philippines, Congress and Department of Commerce and Industry on the foreign market value of all products or articles being exported to the Philippines from the country where said attaches are assigned; Provided, That such report which shall be duly certified by the official rendering the same shall include a statement as to the amount of bounty, subsidy or subvention directly or indirectly granted in. the exporting country for the production, manufacture and/or exportation of the said products or articles: Provided, further, That such attaches on assignment in the same country shall coordinate their efforts in the preparation of their reports: And Provided, finally, That a copy of the report shall be furnished the Tariff Commission.

For purposes of this section the 'foreign market value' shall be the price of the article at which such article is sold or freely offered for sale to all purchasers in the principal markets of the foreign country in the usual wholesale quantities and in the ordinary course of trade for home consumption or, if not sold or offered for sale for home consumption, then for exportation to countries other than the Philippines. No pretended sale or offer for sale, and no sale or offer for sale intended to establish a fictitious market, shall be taken into account.

SEC. 2. The certified reports of the commercial attache duly approved by the chief or head of Mission or office submitted in accordance with the provisions of this Act shall be considered as evidence in the determination of and decision on all cases otherwise subject to special duties as provided for in Book One, Part Two, Title Two of Republic Act Numbered Nineteen hundred and thirty-seven.

SEC. 3. The Secretary of Commerce and Industry in consultation with the Secretary of Foreign Affairs, Secretary of Finance and the Secretary of Agriculture and Natural Resources is hereby authorized to issue such rules and regulations for the effective implementation of the provisions of this Act.

SEC. 4. Failure to render the requisite report under this Act shall make the official concerned liable administratively.

SEC. 5. This Act shall take effect upon its approval.
