[ GSIS RESOLUTION NO. 11, January 26, 2012 ]

SUSPENSION OF THE EVALUATION AND APPROVAL OF PERMANENT TOTAL DISABILITY CLAIMS BASED ON SECTION 16 (D)(5) OF RA 8291



WHEREAS, Section 16 of R.A. 8291 provides that permanent total disability is one of the conditions for entitlement to permanent total disability benefits;

WHEREAS, Section 16 (d) of R.A. 8291 states that:

œ(d) The following disabilities shall be deemed total and permanent:

œ(1)
complete loss of sight of both eyes;
œ(2)
loss of two (2) limbs at or above the ankle or wrist;
œ(3)
permanent complete paralysis of two (2) limbs;
œ(4)
brain injury resulting in incurable imbecility or insanity; and
œ(5)
such other cases as may be determined by the GSIS. 

WHEREAS, the application of Section 16 (d)(5) of R.A. 8291 is under review, there being no clear-cut policy on its application;

RESOLVED, to APPROVE and CONFIRM the suspension of the evaluation and approval of permanent total disability claims based on Section 16 (d)(5) of RA 8291;

RESOLVED, FURTHER, that, pending approval of the policy on permanent total disability falling under Section 16 (d)(5) of R.A. 8291, all applications for permanent total disability benefits under the said item shall be submitted to the Board for approval, upon the recommendation of the assigned Medical Officer from each Operations Group (Luzon, NCR, or VisMin).
