EXPLANATORY NOTE
The rights to own land and to build a home therein are both constitutional and natural rights.

Preceding from the foregoing, it has been the consistent policy of the City Government of Manila to provide housing for its residents.

This policy equally applies to whoever desires to reside in the city regardless of the length of their stay.

This is applied with greater liberlity to those have been residing in the city for several decades already but for reason not of thier own making were not able to acquire their own place of abode.

In this case, a hundred or so families have been staying and occupying a parcel of land measuring 1,231.22 square meters at a place located at Corcuera and Baltaza Streets, Brgy. 88, Zone 7, Distrist 1, Tondo, Manila.  For several decades, they are paying the tax declaration on the land and have earnestly shown their desire to buy the same from the owner.  Generosa Queenie M. Sengco.

It is high-time and proper for the City Government to step in and intervene in behalf of the residents so that socialized housing be set up for disposal at cost to the bona fide residents under the Land-for-Landless Program of the City of Manila.

Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. His Honor, the Mayor, shall be hereby be authorized to cause the acquisition either by negotiation, expropriation or by any other legal means, of that certain parcel of land consisting of One Thousand Two Hundred Thirty-One Square Meters and Twenty-Two Square Decimeter (1,231.22 Sq. M.), more or less, situated at Corcuera and Baltazar Streets, Barangay 88, Zone 7, District 1, Tondo, Manila, registered under the name of Generosa Queenie M. Sengco, married to Ronald A. Sengco, in the Registry of Deeds for the City of Manila, under Transfer Certificate of Title No. 292110, for actual and bona fide residents thereat, under the Land-for-the-Landless Program of the City of Manila.

SEC. 2. This City Mayor is hereby authorized to utilize any available funds in the City Treasury or from any funding facilities of other government agencies for this purpose.

SEC. 3. The aforementioned parcel of land, sought to be acquired, shall be for the benefit of the bona fide tenants/occupants thereat, particular the registered members of the Corbal Brotherhood Association (CBA).

SEC. 4. This Ordinance shall take effect upon its approval.

This Ordinance was finally enacted by the City Council of Manila on February 18, 2016.
