ORDINANCE CREATING THE PASIG OUT-PATIENT FOR DRUG BUSERS AND PASIG CITY DRUG TESTING LABORATORY UNDER THE CITY HEALTH OFFICE.

WHEREAS, Section 16. R.A. 7160 otherwise known as the Local Government Code of 1991 states that every local government unit shall exercise the powers granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare and within their respective territorial jurisdictions, local government units shall ensure and support among other things, the promotion and safety of the people

WHEREAS, in response to the growing problem of drug abuse and in line with the provisions of R.A. No. 9165 otherwise known as the Comprehensive Dangerous Drug Act of 2002 and its implementing Rules and Regulations, there is a need to require to strengthen the Drug Abuse Program on terms of Intervention in Pasig City within the political territory of the City to deter the use of prohibited drug and drug dependence;

WHEREAS, Pasig City Out-Patient Center for Drug Abusers and Pasig City Drug Testing Laboratory is aimed to attain a drug free city, for health and safety concerns and avoiding impairment in performance of work and to assure the public quality of worker-workplace, school place and the community;

WHEREAS, the created Pasig City Out-Patient Center for Drug Abusers and Pasig City Drug Testing Laboratory is aim in meeting one of the requirements in the Licensing of BHFS and Accreditation under the Department of Health; WHEREAS, Pasig City Out-Patient Center for Drug Abusers is a non-residential Treatment and Rehabilitation Center handling of clients involve in drugs some of them already drug dependents;

NOW, THEREFORE, be it ordained as it is hereby ordained by the Sangguniang Panlungsod, in session duly assemble that:

Section 1. Title - This ordinance shall be known as the "Enabling Act of Pasig Out-Patient Center for Drug Abusers and Pasig City Drug Testing Laboratory".

Section 2. Definition of Terms - As used in this ordinance, the following terms shall be used as follows:

  Accreditation - a formal authorization issued by the Department of Health (DOH) to an individual, partnership, corporation or association in compliance with all the licensing requirements (input/structural standards) and accreditation requirements (process standards and outcome/output/impact standards) as prescribed in the Manual of Operations for Treatment and Rehabilitation Centers.
   
  BHFS - this refers to the Bureau of Health facilities and Services.
   
  Center - any of the treatment and rehabilitation centers which undertake treatment, aftercare and follow up treatment of drug dependents. It includes institutions, agencies and the like whose purposes are: the development of skills, arts and technical knowhow, counseling and/or inculcating civic, social and moral values to drug dependent patients, with the aim of weaning them away from dangerous drug and keeping them drug-free, adapted to their families and peers and readjusted into the community as law abiding, useful and productive citizens.
   
  DOH - refers to the Department of Health.
   
  Drug Dependence - a cluster of physiological, behavioural and cognitive phenomena of variable intensity in which the use of psychoactive drug takes on a high priority thereby involving among others, a strong desire or a sense of compulsion to take the substance and the difficulties in controlling the substance taking behaviour in terms of its onset, termination or levels of use
   
  Manual of Operations - a written document giving detailed steps to be followed when undertaking a particular task.
   
  Rehabilitation - a dynamic process including aftercare and follow up treatment as directed towards the physical, emotional/psychological, vocational, social and spiritual change of a drug dependent to enable him/her to live without dangerous drugs, enjoy the fullest life compatible with his capabilities and potentials and render him/her able to become a law abiding and productive member of the community.
   
  Treatment - medical service rendered to a patient for the effective management of physical and mental conditions arising from an individual's drug abuse.
   
  Political Territory - includes clearly defined geographical boundaries within the territorial jurisdiction of Pasig City which the City Government of Pasig has administrative supervision and control
   
  Workplace - is the office, premise or worksite within the City Hall where the workers are habitually employed and shall include the office or place, where the workers who have no fixed or definite worksite regularly report for assignment in the course of their employment. It shall also include venues used by the employer for company functions.

Section 3. Declaration of Policy - It is hereby declared the policy of the Pasig City Government to provide effective mechanisms or measures and to extend moral supports to individuals who have fallen victims to drug abuse or dangerous drug dependence.

Section 4. Coverage -This ordinance shall cover all employees of the City Government of Pasig, national government agencies assigned in Pasig City and the commercial establishments and Non-Government Organizations (NGOs), school place, and community within the political territory of the City of Pasig.

Section 5. PASIG OUT-PATIENT CENTER FOR DRUG ABUSERS
    The Pasig Out-Patient Center for drug Abusers shall:

  1. Medical Consultation and issuance of Drug Dependency Certificate (DDE).
  2. Use proven clinical intervention treatment methods to help make positive life changes through Treatment Clients with Secondary.
  3. Psychosis (Duly Induced) with free antipsychotic medications and other related conditions.
  4. Counseling of clients with different magnitude of addiction.
  5. Help patients resolve interpersonal conflicts, pain, stress, anxiety and other emotional concerns that relate t chemical dependency through different sessions.
  6. Group therapy, sessions that focus on strategies for maintaining sobriety, avoiding relapse, and developing supportive environment for recovery.
  7. Individualized interventions which offer education and support for families helping their loved one through the recovery process.
  8. Anger management.
  9. Smoking cessation program.
  10. Provide spiritual support.
  1. PASIG CITY DRUG TESTING LABORATORY

    The Pasig City Drug Testing Laboratory shall
    1. Serves as an ancillary procedure in the detection of substance use particularly methamphetamine HCL (shabu) and THC (marijuana) among clients suspected of substance abuse, random drug testing in the community, public secondary schools, LGU employees and lastly among clients enrolled in the out-Patient Program.

    2. The facility is limited to just a screening drug test and all positive results will be subjected to a confirmatory drug testing.
Section 6. Enforcement - Pasig City Out-Patient Center for Drug Abusers and Pasig City Drug Testing Laboratory Personnel Office shall cover and entertain all clients involve on drug abuse and the same time monitor compliance of all city employees and job applicants of the City Government with this Drug Testing requirement. Subject to the findings, recommendation and evaluation of the City Health Officer, the City Personnel Officer, after procedural due process, shall immediately file an administrative complaint for grave misconduct in accordance with the pertinent provisions of the Civil Service Law in the event the drug Test of an employee is positive.

Section 7. Organization and Administration.
  1. The administration, operation and maintenance of Pasig Out-Patient for drug abusers and Pasig City Drug Testing Laboratory shall be under the control and supervision of the Pasig City Health Officer for the effective and efficient management of Pasig Out-Patient for drug abusers and Pasig City Drug Testing Laboratory, an Administrative Officer who shall be in-charge of administrative functions pertaining to the operation of the center shall be designated by the City Health Officer subject to the approval of the City Mayor who must be a person of good moral character, a holder in any four (4) year course and a first grade Civil Service eligible or its equivalent. He must have acquired experience in hospital administration or related work at least two (2) years.

  2. The City Health Officer shall prepare the staffing pattern of the Pasig Out-Patient for drug abusers and Pasig City Drug Testing Laboratory in coordination with the Human Resource Management office for the approval of the City Mayor and legislative enactment of the Sangguniang Panlungsod.
Section 8. Fees - The duly assigned and/or appointed Administrative Officer of the Pasig Out-Patient for drug abusers and Pasig City Drug Testing Laboratory in coordination with the Pasig City Health Office shall prepare the schedule of rates of charges including cost of supplies and medicines for services rendered subject to the approval of the City Mayor and the Sangguniang Panlungsod.

Section 9. Appropriation of Funds for Pasig Out-Patient and Pasig City Drug Testing - Initial funding for the operation of the City Government, thereafter, the City officer in coordination with the City Budget Office shall prepare the Budgetary Requirement Annual Procurement Plan (APP) and Project Management Procurement Plan of Pasig Out-Patient and Pasig City Drug Testing for inclusion in the regular budget of the city.

Section 10. Annual Report - The Pasig Out-Patient and Pasig City Drug Testing shall render an annual report of its activities, income and expenditures with recommendation for improvement

Section 11. Repealing Clause - All ordinances and administrative regulations or parts thereof which are inconsistent with any previsions of this ordinance are hereby repealed or modified accordingly.

Section 12. Separability Clause - If for any reason, any part or provisions of this ordinances shall be held to be unconstitutional or invalid, other parts or provisions Hereof which are not affected shall continue to be in full force and effect.

Section 13. Effectivity - this ordinance shall effect fifteen (15) days after publication once in a newspaper of general circulation and posting for three (3) consecutive weeks in all conspicuous places in the City Hall or in local bulletin board.
