SUPPLEMENTAL CLARIFICATORY GUIDELINES IN THE IMPLEMENTATION OF PPA MEMORANDUM CIRCULAR NO. 30-86
1. Date of Filing of Entry Within the FSP - For the purpose of PPA Memorandum Circular No. 30-86, the date of filing of Customs Entry (Import/Export) or covering documents shall unmistakably be understood to be perforated date appearing on the face of the Entry. In the absence thereof, the date stamped on the Entry shall control.
2. Causes of Hold/Seizure/Detention Order - The reason for Hold/Seizure/Detention Order by the Bureau of Customs cognizable as among the grounds for EFSP under PPA Memorandum Circular No. 30-86 are those that are not attributable to the fault of the owner/importer/exporter/consignee or broker. Said persons are conclusively presumed to be at fault, for the purposes of this port regulation, when additional taxes, duties or other charges are assessed/imposed on the cargo subject of the Hold/Seizure/Detention Order by the Bureau of Customs through compromise or otherwise.
All PPA Issuances, orders and administrative decisions which are, inconsistent herewith are hereby deemed modified accordingly.
This Memorandum Circular shall take effect immediately.
