OFFICE OF THE SANGGUNIANG PANLUNGSOD
ORDINANCE MANDATING ALL BUSINESS ESTABLISHMENTS, DORMITORIES/BOARDING HOUSES, TOWNHOUSES, CONDOMINIUMS, TUTORIAL CENTERS, OFFICES, SCHOOLS AND ALL OTHER ESTABLISHMENTS WITH MORE THAN 15 OCCUPANTS LOCATED IN THE CITY OF SAN JUAN TO COME UP WITH THE DISASTER PLAN AND CONDUCT ANNUAL DRILL EXERCISED AND PROVIDING PENALTIES FOR NON-COMPLIANCE THEREOF.

WHEREAS, it is the policy of the City Government of San Juan to promote public safety and general welfare of its citizens. Towards this end, it is the purpose of this ordinance to safeguard the safety physical well-being of people;
WHEREAS, the City of San Juan and its environs have had its share of disasters in the past and where the vast majority of fatalities and injuries occurred in commercial areas and multi-storey buildings where people work, live or stay;
WHEREAS, it is noted that in many of these establishments is the absence of a disaster plan necessary for an effective, ordely and safe evacuation among building occupants. Furthermore, absence of safety provisions in buildings like exit routes maps and signages inside building, ignorance of the conduct life saving procedures and techniques such as the Cardio Pulmonary Resuscitation (CPR) and other basic emergency measures among tenants and occupants is almost a universal observation in these sector of the city thereby unduly exposing people to the effects of disaster;
WHEREAS, the right of the general public to be protected is primordial especially in areas where risks are greater such as public and commercial buildings and the responsibility and accountability of owners must be expected from them by the local government of the City of San Juan;
NOW THEREFORE, BE IT ORDAINED, by the Sangguniang Panlungsod of San Juan, Metro Manila in a session duly assembled that:
Section 1.This Ordinance shall be known as the "DISASTER PREPAREDNESS ORDINANCE OF THE CITY OF SAN JUAN";
Section 2. Definition of Terms - As used in this ordinance, the following terms shall have meanings described to them in this section, unless the context of their usage indicates another meaning:
Eartquake - is a sudden jotting or a movement of the ground as a result of either a tectonic movement of the earth plates or a volcanic eruption. | |
Fire - A rapid, persistent chemical change that releases heat and light and is accompanied by flame, especially the exothermic oxidation of a combustible substance. | |
Flood - An overflow or inundation that comes from a river or other body of water and causes or threatens damage. | |
Typhoon - is a tropical weather disturbance that result from atmospheruc disynchrony resulting to abnormal volume of rain, unusual wind strength and velocity. | |
Cardio Pulmonary Resuscitation (CPR) - An emergency medical procedure called cardio-pulmonary resuscitation applied to patients or victims of near death or even death. | |
Commercial Establishment - a building housing activities of commerce and trade. |
Section 3. A systematic, orderly and safe manner of evacuation must be in place to ensure the people present in a building to avoid injuries and death during the occurence of natural phenomenon like that of an earthquake, typhoon or fire. In relation to the above section, any person having ownership, possession or control of a public place must ensure the safety of its occupants, therefore providing among others, a safe and sound physical design of the owned building/establishment with safety gadgets and implements. as required in Rules VI of the Implementing Rules and Regulations of the National Building Code of the Philippines (PD 1096). The local safety construction and occupancy requirements must be met.
Section 4. It is likewise, unlawful for commercial structures, schools, and other edifices in the city not to have a disaster prepareness and evacuation plan m the aforementioned structmes/establishments.
Section 5. The City Disaster Risk and Reduction Management Office (CDRRMO) and/or the San Juan City Bureau of Fire Protection is hereby tasked to conduct inspection of the establishment's disaster prepareness and evacuation plan and to verify the conduct of this plan on an annual basis.
Section 6. The owner of business or the president / chairman of a corporation or institution shall be held responsible for the non-compliance of this ordinance. Violation of any provision of this Ordinance shall be penalized as follows:
First Offense | : Fine P 1,000.00 | |

Third Offense | : Fine P 5,000.00 | |
and/or imprisonment of five (5) days but not more than seven (7) days at the discretion of the court. |
The City Government may order the closure of any establishment or public place that violates this Ordinance or the non-renewal of its business permit.
Section 7. The City Building and Zoning Office and the City Disaster Risk Reduction and Management Office (CDRRMO) shall promulgate such rules and regulations, with the approval of the City Mayor, as necessary for the effective implementation of this Ordinance.
Section 8. All ordinances contrary to or inconsistent with this ordinance are hereby repealed or modified accordingly.
Section 9. If any provision is declared unconstitutional or illegal, the same shall not affect the validity and effectivity of other provisions hereof.
Section 10. A copy of this ordinance shall be furnished the City Planning Office, City Engineering Office, the Philippine National Police, San Juan City Bureau of Fire Protection, the Public Information Department, the local Chamber of Commerce, all owners of commercial building, schools located in the City of San Juan.
Section 11. This ordinance shall take effect two (2) months following its approval and publication.
