[ PRC BOARD OF MECHANICAL ENGINEERING RESOLUTION NO. 30, October 21, 1991 ]

AMENDMENT OF SECTION 7 OF THE RULES AND REGULATIONS OF THE BOARD



WHEREAS C.A. No. 294 - the œMechanical Engineering Law , as amended by R.A. No. 5336 and P.D. No. 223, under Section 22 thereof does not specifically provide the passing grade or rating that a candidate must obtain;

WHEREAS, P.D. No. 223, under Section 6, (g) thereof, the Board, subject to approval by the Commission, can determine the appropriate passing general rating if not provided for in the law regulating the profession;

WHEREAS the Board, pursuant to the foregoing provisions, prescribed in Section 7 of the Rules and Regulations thereof, the general average rating of 75% and later amended the same Section on January 25, 1984 in Res. No. 2, (Approved by the Commission and published in the Official Gazette issue of February 20, 1984, Vol. 80, No. 8, pp. 1168-1169), to read, to wit:

"Sec. 7. The candidate must obtain a general average of at least 75% and should have not less than 60% in any subject in order to pass. An applicant who for the third time fails to pass the examination for the same grade shall not be allowed to take another until at least one year has elapsed after the last examination."

WHEREAS equity, propriety, and uniformity prudently and judiciously dictate the Board to adopt the general passing average rating of 70% in the other Engineering Licensure Examinations, which, as the standard of gauging the knowledge, skill, and competence of a candidate for registration or licensure to the practice of the profession, is in accord with the technical aspect and degree of difficulty encountered in taking the examination; and

WHEREAS the Board adopted the general passing average of 70% with no grade less than 50% in any subject for the April, 1991 Mechanical Engineering Licensure Examination,

NOW, THEREFORE, by virtue of the powers vested by laws, be it resolved by the Board, as it is hereby resolved, to amend Sec. 7 of the Rules and Regulations of the Board to read, to wit:

"Sec. 7. The candidate must obtain a general passing average rating of at least 70% with no less than 50% in any subject. An applicant who thrice fails to pass the examination for the same grade shall not be allowed to take another until at least one year shall have lapsed after the last examination."

BE IT RESOLVED FURTHER that the adoption of the said general passing average rating of 70% with no rating below 50% in any subject in the April, 1991 Mechanical Engineering Licensure Examinations be IN ORDER;

BE IT RESOLVED FURTHERMORE that the said new general passing average rating and qualifying rating in any subject be enforceable and applicable in the October, 1991 and subsequent Mechanical Engineering Licensure Examinations;

BE IT RESOLVED FINALLY that the herein Resolution, upon approval by the Commission, be effective after fifteen (15) days following the completion of the publication thereof in the Official Gazette or any newspaper of general circulation.
