[ EXECUTIVE ORDER NO. 71, November 06, 1945 ]

PROHIBITING DURING THE PRESENT EMERGENCY THE PRODUCTION OR MANUFACTURE OF ALCOHOL OR FERMENTED OR SPIRITUOUS LIQUORS OR ANY OTHER ALCOHOLIC BEVERAGE FROM SUGAR, SUGAR CANE PRODUCTS, RICE, CORN, SWEET POTATOES AND CASSAVA.



WHEREAS, there exists in this country a shortage of sugar, rice, corn, sweet potatoes, and cassava; WHEREAS, a portion of the existing stocks of these commodities is being used for the production of alcoholic beverages to the detriment of the national economy; and

WHEREAS, such conversion of these products into beverage alcohol increases the price of the remaining portion of the stock available for consumption;

NOW, THEREFORE, I, SERGIO OSME A, President of the Philippines, by virtue of the powers vested in me by the Constitution and laws of the Philippines, do hereby order: 
1.
That effective on the date of the promulgation of this Executive Order until December 31, 1946, unless otherwise ordered, the production or manufacture of alcohol or fermented or spirituous liquors or any other alcoholic beverage from the juice, syrup, or sugar of the sugar cane in the form of refined sugar, centrifugal sugar, muscovado, panocha, or in any other form, (except waste molasses), rice, corn, sweet potato, and cassava, is hereby prohibited: Provided, however, That the manufacture of alcohol from said commodities may be authorized by the Secretary of Agriculture and Commerce for medicinal and industrial uses when no substitutes are immediately available in the place where it is to be used.

That any violation of the provisions of this Order shall be punished by a fine not exceeding two thousand pesos or by imprisonment not exceeding two years, or by both such fine and imprisonment in the discretion of the court, When the offender is a firm, partnership, or corporation, the manager or president thereof or person charged with the management of the business of such firm, partnership or corporation shall be liable to the penalties herein prescribed. All the finished products, raw materials, implements and machinery used in the production or manufacture of such alcohol, fermented or spirituous liquors or alcoholic beverage shall be confiscated. 
3.
All Acts or parts of Acts inconsistent with the provisions of this Order are hereby suspended.
