REPEAL OF MEMORANDUM CIRCULAR NO. 01, SERIES OF 2011 (RE: SUBMISSION TO THE OMBUDSMAN OF THE LIST OF ANNUAL PROCUREMENT SCHEDULES FOR CY2011 AND EVERY YEAR THEREAFTER ON OR BEFORE THE 15TH DAY OF FEBRUARY AND TO POST THE SAME IN CONSPICUOUS PLACES AND UPLOAD IN OFFICIAL WEBSITES)

Considering that (i) the Government Procurement Policy Board - Technical Support Office is publishing Annual Procurement Plans (APPs) and Procurement Monitoring Reports on its website (www.gppb.gov.ph) pursuant to Executive Order No. 662 (2007), as amended and Administrative Order No. 222 (2008); (ii) the posting of government data including APPs on the government agencies official websites is being required under the Transparency Seal provisions in the General Appropriations Acts; and (iii) the Office of the Ombudsman may, at any time, request any government agency for assistance and information necessary in the discharge of its responsibilities, and examine, if necessary, pertinent records and documents , in the course of monitoring the procurement activities of any government agency, the rationale of Memorandum Circular No. 1, series of 2011 is being sufficiently attained and realized.
In view of the foregoing and to avoid any duplication/redundancy of effort and overlapping of functions, Memorandum Circular No. 1, series of 2011 - directing the submission to the Ombudsman of the list of annual procurement schedules for CY2011 and every year thereafter on or before the 15th day of February and to post the same in conspicuous places and upload in official websites - is hereby repealed.
Strict observance of Republic Act No. 9184, its implementing rules and regulations, and other related issuances, however, remains enjoined.
This Memorandum Circular shall take effect after fifteen (15) days following the completion of its publication in a newspaper of general circulation and upon filing of three (3) certified copies thereof with the University of the Philippines Law Center.
