[ PROCLAMATION NO. 402, March 31, 1957 ]

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 217, DATED FEBRUARY 16, 1929, CERAIN PARCEL OF THE PUBLIC DOMAIN EMBRACED THEREIN SITUATED IN SITIO LAMMIN, BARRIO CARASI, MUNICIPALITY OF PID-DIG, PROVINCE OF ILOCOS NORTE, AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF THE MINING ACT



WHEREAS, under the provisions of section fourteen of a certain parcel of land from the operation of Proclamation No. 217, dated February 16, 1929, which established the Central Cordillera Forest Reserve;

WHEREAS, the findings of the Director of Mines, show that the area sought to be excluded from the Central Cordillera Forest Reserve appears to be highly mineralized; and

WHEREAS, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, land within reservations for purposes other than mining, which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservation by the President with the concurrence of the Congress of the Philippines.

NOW, THEREFORE, upon the recommendation of the Secretary of Agriculture and Natural Resources and pursuant to the provisions of section 14 of Commonwealth Act No. 137, otherwise known as the Mining Act, I, Carlos P. Garcia, President of the Philippines, do hereby exclude from the operation of Proclamation No. 217, dated February 16, 1929, certain portion of the Central Cordillera Forest Reserve and declare the same open to disposition under the provisions of the Mining Act, situated in sitio Lammin, barrio of Carasi, municipality of Piddig, province of Ilocos Norte, as shown in the Bureau of Mines Map Bsm-87-D, and particularly described to wit:

Beginning at corner 1, which is N. 34 48 E., 19,201.74 meters from B.L.L.M, No. 1 of the municipality of Solsona, Ilocos Norte; thence N. 4 00 W., 1,872.56 meters to corner 2; thence N. 70 00 E., 3,199.86 meters to corner 3; thence S. 20 00 E., 3,000 meters to corner 4; thence S. 70 00 W., 4,060.11 meters to corner 5; thence N. 4 00 W., 1,248.37 meters to the point of beginning.

All points referred to are indicated on the plan and are marked on the ground as follows:

Corner 1 is, an old œX  on 20 X 20 cm. rock and identical to corner of Pla-338 of the Coburn-Paracale Mining Company.

Corners œ2 , 3 , œ4  and œ5  are cylindrical concrete monuments15X6cm.

The cutting, removal, and utilization of timber and other forest products therefrom shall be in accordance with existing Forest and Internal Revenue Laws and Regulations, and at any time the said area shall be abandoned for mining purposes, the same shall revert as part of the Central Cordillera Forest Reserve.

This Proclamation shall take effect only upon the concurrence of the Congress of the Philippines.
