[ PROCLAMATION NO. 118, February 22, 1949 ]
MAKING PUBLIC THE TREATY OF FRIENDSHIP AND GENERAL RELATIONS BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE ITALIAN REPUBLIC.
WHEREAS, a Treaty of Friendship and General Relations between the Republic of the Philippines and the Italian Republic, designed to strengthen the relations of amity and good understanding which happily exist between the two countries, was concluded and signed by the respective Plenipotentiaries of the two Governments at Rome, on July ninth, nineteen hundred and forty-seven;
WHEREAS, the Senate of the Philippines, by its Resolution No. 50 adopted on May 4, 1948, concurred in the making of the said Treaty of Friendship and General Relations, subject to a reservation, as follows:
Resolved, That the Senate of the Philippines concur, as it hereby concurs, in the Treaty of Friendship and General Relations between the Republic of the Philippines and the Italian Republic which was concluded and signed at Rome on July ninth, nineteen hundred and forty-seven, with the understanding, that nothing in the Treaty shall be construed as affecting, altering, amending or repealing any of the existing constitutional provisions, statutes, or laws, of the Republic of the Philippines prohibiting aliens, or limiting or regulating their rights to acquire, possess, and dispose of movable or immovable property, to establish and maintain schools of learning, to reside and travel, and to engage in trade, industry, and other pursuits.
WHEREAS, the said Treaty has been duly ratified and confirmed by the President of the Philippines subject to the reservation in the resolution of concurrence of the Philippine Senate, quoted above;
WHEREAS, the said Treaty has been duly ratified by the Government of the Republic of Italy;
WHEREAS, the instruments of ratification of the two Governments were exchanged at Manila, Philippines, on the tenth day of December, nineteen hundred and forty-eight; and
WHEREAS, it is stipulated in said Treaty that it shall enter into operation on the date of exchange of ratifications;
NOW, THEREFORE, be it known that I, Elpidio Quirino, President of the Philippines, have caused the said Treaty, a certified copy of which is hereto annexed, to lie made public to the end that the same and every article and clause thereof may be observed and fulfilled with good faith by the Republic of the Philippines and the citizens thereof, subject to the aforesaid reservation.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
