OF 2005 œRECLASSIFYING EPHEDRINE AND PSEUDOEPHEDRINE AS DANGEROUS DRUGS  BY INCLUDING THE ISOMERS AND SALTS OF ISOMERS OF EPHEDRINE AND PSEUDOEPHEDRINE AND BY INCLUDING FURTHER THEIR HALOGENATED AND ALKYLATED FORMS THEREOF AND THE SALTS, ISOMERS, AND SALTS OF ISOMERS OF THESE FORMS AS WELL AS ANY MATERIAL, COMPOUND, MIXTURE OR PREPARATIONS CONTAINING THE SAME, IN THE LIST OF DANGEROUS DRUGS

WHEREAS, Ephedrine and Pseudoephedrine are precursors under Table I of the 1988  United  Nations  Convention  Against  Illicit  Traffic  in  Narcotic  Drugs  and Psychotropic Substances;

WHEREAS,   pursuant  to  Section  93,  Article  XI  of  Republic  Act  No.  9165, otherwise  known as œThe Comprehensive  Dangerous  Drugs Act of 2002  , the Board is given the power to reclassify, add to or remove any chemical from the list of dangerous drugs;

WHEREAS,   the Dangerous  Drugs Board, in Board Regulation  No. 4, series of 2005, has reclassified Ephedrine and Pseudoephedrine as dangerous drugs;

WHEREAS, there have been a total of 358.1083 kgs of chloroephedrine, a halogenated form of ephedrine, seized in July 2016 by the Philippine Drug Enforcement Agency (PDEA);

WHEREAS, illicit drug manufacturers are continuously experimenting with and synthesizing various forms of ephedrine and pseudoephedrine for use in methamphetamine  manufacture  and  the  PDEA  needs  to be  proactive  against these   illegal drugs manufacturers by including all forms of ephedrine and pseudoephedrine.

WHEREAS,  halogenated  forms  (containing  chlorine,  bromine  , iodine,  fluorine, and alkylated forms (containing branched chain carbon atoms) of ephedrine and pseudoephedrine  can conceivably be used as precursors for the manufacture of methamphetamine;

WHEREAS, the PDEA recommended that the above forms of ephedrine and pseudoephedrine be likewise reclassified as dangerous drugs;

THEREFORE, be it RESOLVED, as it is hereby RESOLVED, to amend Section 1 of Board Regulation No. 4, s. of 2005, to read as follows:

SECTION 1. Classification of Ephedrine and Pseudoephedrine as Dangerous Drugs - All raw materials of Ephedrine and pseudoephedrine  or any of their salts, as well as preparations containing any of the said drugs are hereby reclassified  as Dangerous  Drugs, including  their isomers  and salts of isomers, and their halogenated and alkylated forms and the salts, isomers, and salts of isomers   of  these   forms   as   well   as   any   material,   compound,   mixture   or preparation   containing   the  same  shall  be  subject  to  all  regulatory   control measures provided under Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002 and the rules and regulations promulgated by the Board.

EFFECTIVITY  - This Regulations shall take effect fifteen (15) days after its publication in two (2) newspapers  of general circulation and registration  with the  Office  of  the  National  Administrative  Register  (ONAR),  UP  Law  Center, Diliman, Quezon City .
