[ ADVISORY NO. 17, S. 2018, March 21, 2018 ]

CRIMINAL PROSECUTION AND IMPRISONMENT FOR SUBMISSION OF FALSE EMPLOYMENT DOCUMENTS

Adopted: 12 March 2018
Date Filed: 21 March 2018

It has come  to the attention  of the POEA  that many  OFWs  employed  as nurses  in Damman,  Eastern  Saudi  Arabia,  have  been  criminally  charged  and now  in  prison   because   of  submitting   falsified   or  fabricated   certificates   of employment.  The Kingdom of Saudi Arabia (KSA) has engaged the services of Data   Flow,   a   Singaporean   based   company,   to   verify   the   authenticity   of employment  documents  including  certificates  of employment,  professional licenses, skills certificate, and the like.

In line with this, the POEA is appealing to all workers applying for overseas employment to submit only truthful and authentic employment documents. Submitting  fabricated  employment  documents  will  result  not  only  to  dismissal from employment  but also to criminal prosecution  and imprisonment,  especially in the KSA. OFWs are advised to report to the POEA individuals or recruitment agencies that are responsible for fabrication of employment documents.

Recruitment  agencies  are reminded  that it is their obligation  to make sure that all employment  documents  submitted  by their applicants  are genuine  and they will face appropriate administrative and criminal charges should they fail to perform this obligation.

For the information and guidance of all concerned.
