AMENDING RULE 9 SECTION 2(C) OF THE BUREAU OF IMMIGRATION OMNIBUS RULES OF PROCEDURE OF 2015

WHEREAS, it is BI ™s mandate to effectively and immediately deport fugitives from justice;
 
WHEREAS, Rule 9 Section 2(c) [Summary Deportation] of the Bureau of Immigration Omnibus Rules of Procedure of 2015 defines fugitive from justice as œa foreigner who has been tagged as such by the authorized personnel of a foreign embassy or by the International Police and whose passport is cancelled by his embassy/consulate. 
 
WHEREAS, the cancellation of the fugitive ™s passport takes considerable amount of time;

WHEREAS, the delay in the cancellation of passports impedes the issuance of deportation orders and causes prolonged detention of fugitives from justice at the Bureau of Immigration Warden ™s Facility worsening congestion problems and further burdening the Government;

NOW THEREFORE, pursuant to the rule-making power of the Commissioner under CA 613, Sec. 3, the following rules shall govern:

Section 2. (c) Fugitive from justice - A fugitive from justice refers to a foreigner who has been tagged as such by the authorized personnel of a foreign embassy or by the International Police or whose passport is cancelled by his embassy/consulate.

All inconsistent issuances are hereby repealed and/or modified accordingly. Effective upon publication.
