REITERATION OF THE RULES AND REGULATIONS FOR CONSUMER PROTECTION IN A TRANSACTION MADE THROUGH ELECTRONIC MEANS AS PRESCRIBED UNDER THE JOINT DTI-DOH-DA ADMINISTRATIVE ORDER NO. 01 SERIES OF 2008

The Food and Drug Administration (FDA), a regulatory agency under the Department of Health, with the mandate to ensure the safety, efficacy and quality of health products as defined in Republic Act (RA) No. 9711, otherwise known as œThe Food and Drug Administration Act of 2009 , hereby reiterates the rules and regulations for consumer protection in a transaction made through electronic means as prescribed under the Joint DTI-DOH-DA Administrative Order No. 01 series of 2008 issued on 20 October 2008 for compliance of all concerned stakeholders and parties.

As covered by the Joint DTI-DOH-DA Administrative Order No. 01 series of 2008, all retailers, sellers, distributors, suppliers or manufacturers engaged in electronic commerce with consumers are hereby directed to ensure compliance with the requirements for safe and quality health products by placing in the market only FDA-authorized health products.

Any violation of the provisions prescribed under the Joint DTI-DOH-DA Administrative Order No. 01 series of 2008 shall be dealt with in accordance with RA 9711, RA 7394, otherwise known as the œConsumer Act of the Philippines , their Implementing Rules and Regulations, and other applicable laws.

This Circular shall take effect immediately and shall remain valid unless otherwise revoked, repealed or rescinded.
