COMPLIANCE WITH EMISSION STANDARDS FOR THE IMPORTATION OF USED MOTOR VEHICLES AND PARTS AND COMPONENTS UNDER THE PHILIPPINE CLEAN AIR ACT OF 1999

WHEREAS, Republic Act No. 8749, otherwise known as the œPhilippine Clean Air Act of 1999 , declares that the State shall pursue a policy of balancing development and environmental protection;

WHEREAS, Republic Act No. 8749, mandates the Department of Environment and Natural Resources (DENR), in collaboration with the relevant agencies, to develop an action plan for the control and management of air pollution from motor vehicles consistent with the Integrated Air Quality Framework;

WHEREAS, Republic Act No. 8749 tasks DENR to review, revise and publish the emission standards for motor vehicles every two (2) years, or as the need arises and  shall  consider  the  maximum  limits  for  all  major  pollutants  to  ensure substantial improvement in air quality for the health, safety and welfare of the general public;

WHEREAS, DENR Administrative Order No. 04, series of 2015, entitled œImplementation of Vehicle Emission Limits for Euro 4/IV, and In-Use Vehicle Emission  Standards   issued  on  25  March  2015,  provides  for  the  specific emission limits/standards for motor vehicles, including used motor vehicles, effective 91 July 2015;

WHEREAS, Executive Order 156, series of 2002, entitled œProviding for a Comprehensive   Industrial   Policy   and   Directions   for   the  Motor   Vehicle Development Program and its Implementing Guidelines  and Executive Order 877-A, series of 2010, entitled œThe Comprehensive Motor Vehicle Development Program  , prohibited the importation of used motor vehicles into the Philippine territory, except for select types of vehicles provided that they are in compliance with the current emission standards set by the DENR; and

WHEREAS, DTI Administrative Order 08, series of 2003, entitled œGuidelines for the Mandatory Accreditation of Rebuilding Centers , assures the public that all rebuilt trucks meet the standards in exhaust emission;

WHEREAS, Section 23 of Republic Act No. 8749 provides that any imported secondhand motor vehicle engine shall not be introduced into commerce, sold or used unless it complies with the emission standards set pursuant thereto;

NOW, THEREFORE, for and consideration of the foregoing premises, the following are hereby prescribed to supplement the implementation of the provisions of Republic Act 8749.
1.    For the importation of completely built-up (CBU) used motor vehicles, the Certificate of Authority (CAI) to Import shall be issued only upon submission of a certification that the units are compliant with Euro 4 emission standards set forth under DENR DAO 04 s. 2015 pursuant to Republic Act No. 8749, as follows:

- 2.0 [registered for the first time after December 31, 2015]

- 2.5 [registered for the first time on or before December 31, 2015]

2.    For truck rebuilding activities in the country, only Euro 4 compliant used parts and components shall be allowed for importation. This shall be evidenced by a duly issued certification or any documentary proof showing compliance with Euro 4 emission standards.
The certification must be issued by the authorized vehicle standards agency or vehicle/parts manufacturer in the country of origin and duly authenticated by the Philippine Embassy or Commercial Attache.
