WHEREAS, the Metro Manila Council issued MMDA Regulation No. 17-004, Series  of  2017  therein  œEstablishing  the  High  Occupancy  Vehicle  Lanes  in EDSA ;

WHEREAS, a recent vehicular volume count conducted by the MMDA revealed that seventy percent (70%) of the motor vehicles that ply EDSA are occupied only by their dirvers;

WHEREAS, in order to further maximize the number of passengers that may be conveyed through EDSA, there is a need to expand the High Occupancy Vehicle (HOV) Lanes thereat;

NOW, THEREFORE, be it resolved, as it is hereby resolved, that the Metro Manila Council declares, thus:

1.    HOV Lanes are established in all lanes of EDSA from Balintawak, Quezon City until Magallanes, Makati City, both northbound and southbound. All other ordinances, resolutions, and regulations of the Metro Manila Council not otherwise contrary to or inconsistent with this Regulation shall remain in full force and effect.

2.    A HOV is defined as all public and private motor vehicles except motorcycles with at least two (2) occupants including the driver, i.e., driver and at least one (1) passenger.

3.    Non-HOVs are prohibited from traversing EDSA from Balintawak, Quezon City until Magallanes, Makati City, both northbound and southbound, from
7:00 a.m. until 10:00 a.m. and from 6:00 p.m. until 9:00 p.m. from Monday to Friday. However, the crossing of EDSA at intersections shall be allowed. A fine of One Thousand Pesos (Php1,000.00) shall be imposed for a violation of this Regulation.

4.    The  MMDA  Chairman  is  hereby  authorized  to  issue  the  necessary Implementing Rules and Regulations in order to properly enforce this Regulation.

5.    A public information campaign shall immediately be conducted by the MMDA and a dry run shall commence from 15 August 2018 until 22 August 2018.

6.    The full implementation of this Regulation shall start on 23 August 2018 after it shall have been published in two (2) newspapers of general circulation and submission of a copy thereof with the Office of the National Administrative Register, U.P. Law Center.
