AN ACT SEPARATING THE SITIO OF PANGAYLAN-IP FROM BARANGAY POBLACION I IN THE MUNICIPALITY OF SANTIAGO, PROVINCE OF AGUSAN DEL NORTE, AND CONSTITUTING IT INTO AN DISTINCT AND INDEPENDENT BARANGAY TO BE KNOWN AS BARANGAY PANGAYLAN-IP
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Creation of Barangay Pangaylan-IP. — The sitio of Pangaylan-IP is hereby separated from Barangay Poblacion I in the Municipality of Santiago, Province of Agusan del Norte and constituted as a distinct and independent barangay to be known as Barangay Pangaylan-IP.
SECTION 2. Territorial Boundaries. — The territorial boundaries of Barangay Pangaylan-IP are hereby described as follows:
"Bounded on the North by Barangay Poblacion II;
On the East by Provincial Boundary of Agusan del Norte and Surigao del Sur;
On the West by Barangay Poblacion I and Barangay Poblacion II; and
On the South by Barangay Poblacion I."
SECTION 3. Conduct and Supervision of Plebiscite. — The plebiscite conducted and supervised by the Commission on Elections (COMELEC) pursuant to Provincial Ordinance No. 266-2010 of the Sangguniang Panlalawigan of the Province of Agusan del Norte, which ratified the creation of Barangay Pangaylan-IP as proclaimed by the Plebiscite Board of Canvassers on March 5, 2011 shall serve as substantial compliance with the plebiscite requirement under Section 10 of the Local Government Code of 1990, as amended.
SECTION 4. Incumbent Barangay Officials. — The incumbent elected barangay officials of Barangay Pangaylan-IP shall continue to hold office until such time that their successors have been duly elected and qualified.
SECTION 5. Public Infrastructure and Facilities. — All public infrastructure and facilities existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new Barangay Pangaylan-IP.
SECTION 6. Internal Revenue Allotment Shares. — Barangay Pangaylan-IP shall be entitled to internal revenue allotment (IRA) shares pursuant to Section 285 of the Local Government Code of 1990, as amended.
SECTION 7. Effectivity. — This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
