AN ACT SEPARATING SITIO OF PANACAN-2 FROM BARANGAY PANACAN IN THE MUNICIPALITY OF NARRA, PROVINCE OF PALAWAN AND CONSTITUTING IT INTO A SEPARATE AND INDEPENDENT BARANGAY TO BE KNOWN AS BARANGAY PANACAN 2



Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Creation of Barangay Panacan-2. — Sitio Panacan-2 is hereby separated from Barangay Panacan in the Municipality of Narra, Province of Palawan to constitute a separate and independent barangay to be known as Barangay Panacan-2.

SECTION 2. Territorial Boundaries. — The territorial boundaries of Barangay Panacan-2 are hereby described as follows:

"Bounded on the Northwest along Lines 1 to 6 by Barangay Poblacion; on the Northeast along Lines 6, 7, 8, 9, and 10 by Lot 8035, CAD, 797-D, Narra Cadastre and Barangay Antipuluan; on the Southeast along Lines 10 to 21 by Sulu Sea; and on the Southwest along Lines 21 to 49-1 by Lot 1, PB-4B-000019, Panacan-1.

Containing an area of three million fourteen thousand five hundred forty-five (3,014,545) square meters, more or less."

SECTION 3. Conduct and Supervision of Plebiscite. — The plebiscite conducted and supervised by the Commission on Elections (COMELEC) pursuant to Sangguniang Panlalawigan ng Palawan Provincial Ordinance No. 935, Series of 2006, as amended, which was duly ratified and proclaimed by the Plebiscite Board of Canvassers on December 16, 2006, shall serve as substantial compliance with the plebiscite requirement under Section 10 of the Local Government Code of 1991, as amended. 

SECTION 4. Barangay Officials. — The incumbent elected barangay officials of the said barangay shall hold office in Barangay Panacan-2 until such time that a new set of officers have duly elected and qualified.

SECTION 5. Public Infrastructure and Facilities. — All public infrastructure and facilities existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new barangay.

SECTION 6. National Tax Allotment Shares. — Barangay Panacan-2 shall be entitled to an allotment from national taxes pursuant to Section 285 of the Local Government Code of 1991, as amended.

SECTION 7. Effectivity. — This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
