[ MEMORANDUM CIRCULAR NO. 9, October 25, 2022 ]
REVOKING ITEM 4 OF MEMORANDUM CIRCULAR NO. 3 (S. 2022) WHICH PROHIBITS CERTAIN GOVERNMENT AGENCIES AND INSTRUMENTALITIES FROM ENTERING INTO NEW CONTRACTS AND DISBURSING EXTRAORDINARY FUNDS
In order to ensure continuity in government operations and delivery of services to the public, and taking into account the assumption to duty of newly-appointed heads of government departments, agencies, and instrumentalities, as well as the policy direction provided by the Administration through, among others, the two 8-Point Socioeconomic Agenda and the Medium Term Fiscal Framework, Item 4 of Memorandum Circular (MC) No. 3, (s. 2022), is hereby REVOKED.
Accordingly, in the execution of contracts, whether new or renewal, and disbursement of funds, all government departments, agencies, bureaus, offices and instrumentalities, including government-owned or -controlled corporations, government instrumentalities with corporate powers, government corporate entities, government financial institutions, and free port and special economic zone authorities are hereby directed to:
1. Strictly comply with Republic Act No. 9184 or the "Government Procurement Reform Act," and its Implementing Rules and Regulations, as amended, as well as applicable budgeting, accounting and auditing laws and issuances; and
2. Ensure judicious use of government resources and strict observance of the ethical norms of honesty, integrity, and efficiency.
Except as expressly modified by this Circular, all other provisions of MC No. 3 shall remain in full force and effect.
This Circular shall take effect immediately.
