ADOPTING THE NATIONAL CYBERSECURITY PLAN 2023-2028, AND DIRECTING THE IMPLEMENTATION THEREOF



WHEREAS, Section 24, Article II of the Constitution recognizes the vital role of communication and information in nation-building;

WHEREAS, under Section 2 of Republic Act (RA) No. 10844 or the "Department of Information and Communications Technology (DICT) Act of 2015," the State shall ensure the provision of strategic, reliable, cost-efficient, and citizen-centric information and communications technology (ICT) infrastructure, systems, and resources as instruments of good governance and global competitiveness; 

WHEREAS, Executive Order (EO) No. 189 (s. 2015), as amended by EO No. 95 (s. 2019), established the National Cybersecurity Inter-Agency Committee (NCIAC) to assess the vulnerabilities and risks of the country's cybersecurity, and enhance existing mechanisms to detect cyber-attacks, minimize cyber risks and increase cyber resiliency;

WHEREAS, the strengthening of security and resilience of the Philippine cyberspace is one of the key strategies to ensure safety and security in cyber and physical spaces under the Philippine Development Plan 2023-2028;

WHEREAS, pursuant to its mandate under Section 15 of RA No. 10844, the DICT formulated the National Cybersecurity Plan (NCSP) 2023-2028, which outlines the country's policy direction and provides operational guidelines towards a trusted, secured, and resilient cyberspace for every Filipino;

WHEREAS, it is imperative for all concerned national government agencies and instrumentalities, and local government units (LGUs) to support and cooperate towards the successful implementation of the NCSP 2023-2028; and

WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the duty to ensure the faithful execution of laws;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Adoption, Alignment, and Implementation of the NCSP 2023-2028. The NCSP 2023-2028 is hereby adopted as the whole-of-nation roadmap for the integrated development and strategic direction of the country's cybersecurity.

All national govenrment agencies and instrumentalities, including government-owned or -controlled corporations are hereby directed, and all LGUs are hereby encouraged, to formulate, adopt and implement their cybersecurity plans and strategies, which are relevant to their respective mandates, in accordance with the NCSP 2023-2028.

The DICT shall adopt a system for the effective implementation, monitoring, an review of the NCSP 2023-2028, subject to existing laws, rules and regulations. As may be necessary, the DICT, in cooperation with the private sector, shall provide technical assistance to other government agencies and offices relative to the implementation of the NCSP 2023-2028.

Section 2. Reporting. The DICT shall submit to the President, through the Office of the Executive Secretary and NCIAC, a bi-annual report on the status and progress of the implementation of the NCSP 2023-2028.

Section 3. Funding. The funding requirements for the implementation of this Order shall be charged against current and available appropriations of concerned agencies, subject to pertinent budgeting, accounting, and auditing laws, rules and regulations. Thereafter, the funding requirements necessary for the continued implementation of this Order shall be included in the General Appropriations Act, subject to the usual budget preparation process.

Section 4. Separability. If any section or part of this Order is declared unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force and effect.

Section 5. Repeal. Al other orders, guidelines, rules, regulations, and issuances or parts thereof, which are inconsistent with the provisions of this Order, are hereby repealed or modified accordingly.

Section 6. Effectivity. This Order shall take effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
